Do I Have to Attend an Independent Medical Examination?

Our clients frequently ask whether they will have to attend an independent medical examination (IME). They are often fearful about attending a physical or mental evaluation by the employer/insurer’s expert.

An Employee must attend an employer/insurer’s reasonable request for an IME

According to Minnesota Statutes section 176.155, subdivision 1, “The injured employee must submit to examination by the employer’s physician, if requested by the employer, and at reasonable times thereafter upon the employer’s request.”

Proposed Bipartisan Legislation Seeks to Help Minnesota’s Firefighters

Firefighters are exposed to mentally taxing and traumatic events on a regular basis. From burning buildings, to medical emergencies, to car accidents, to various other crises in between, any call on any day can bring daring rescues that firefighters must be ready to respond to at any moment. In some cases, that response is to a call involving severe injuries or even unexpected deaths with little time to process or decompress from the event they just witnessed before having to move on to the next call.

Arguing . . . in the Alternative

There are many ways to win an argument. Oftentimes, an experienced attorney will make arguments “in the alternative” to increase the probability of winning.

When I argued before the Minnesota Supreme Court in January, 2020 (see below), I argued four alternative perspectives to put my client in the best position to win her case, and to ensure the best outcome for future cases affected by the Court’s decision.

Yesterday Was a Day of Pain

Jen Yackley & I originally met with Dana (who wrote the story below), her husband Ed & his service dog Rex to hear their story and learn how I can help. They founded an organization called Solder’s 6 whose mission is to provide honorably discharged veterans, police officers, and firefighters with specially trained K-9 dogs . The support they provide these brave individuals is nothing short of amazing and, unfortunately, very needed. We hear from our police officer & firefighter clients with PTSD that the suffering doesn’t end when the job is over and many don’t want the job to end.
